Regulation of Urban Planning Violations
Regulation of urban planning violations - settlement of arbitrary constructions and uses - legalization, according to the new favorable provisions of Law 4178/2013.
The new law gives you the opportunity until 08/02/2015 to take advantage of the regulations and installments and to achieve either settlement of arbitrariness for 30 years or even final legalization.
After the appropriate arrangement, you are able to receive a Certificate of Legality and proceed to any legal deed for your property.
Categories of arbitrariness:
- Category 1: Arbitrary constructions in buildings with residential use that exist before 9/6/1975.
Violations of this category are permanently excluded from demolition by paying a fee of 500 euros, without penalty
- Category 2: Arbitrary constructions that exist before 1/1/1983.
Violations of this category are definitively excluded from demolition by paying the corresponding fee and the single special fine.
- Category 3: Arbitrary minor offenses
Arbitrary minor offenses are permanently excluded from demolition by paying only a fee of 500 euros without penalty.
- Category 4: Arbitrary constructions or arbitrary changes of use, as long as the urban coverage and building sizes are not violated in a percentage of more than 40% and the urban size of the height in a percentage greater than 20%. Also the arbitrary constructions or changes of use for which the conservation process has been completed in accordance with the provisions of Laws 3775/2009, 3843/2010 (Birbilis law) and 4014/2011 (Papakonstantinou law).
Suspension of sanctions is achieved for 30 years after the payment of a fee and a special fine. Upon completion of the building identity are permanently excluded from demolition.
- Category 5: All other arbitrary constructions and changes of use that do not fall into the previous categories.
The suspension of sanctions is achieved for 30 years and the payment of a fee and a special fine is required and for each inclusion of this category, within seven (7) years from the publication of the law, the data submitted by a building inspector are checked.
Repayment method and installments:
Depending on the date of affiliation the fine can be paid to:
102 monthly installments or 17 semi-annual installments (submission until 8/2/2014),
84 monthly installments or 14 semi-annuals (submission until 8/8/2014),
60 monthly installments or 10 semi-annuals (submission until 8/2/2015).
The minimum monthly installment is set at 50 euros, while the minimum six-month installment is set at 300 euros. A 20% discount applies for a one-time payment of the fine, while a 10% discount is provided for an advance payment of 30% of the fine.
